Let's Run Barcelona with Brooks Ghost Max


1. PROMOTING ENTITY

Brooks Sports, B.V. (“Brooks”), who can be contacted at Olympisch Station 33, 1076 DE Amsterdam, the Netherlands, in the person of ERWIN KRAK.

3. AREA OF DISSEMINATION

The Contest will take place for physical purchases, within the entire territory of the Netherlands, Belgium, Germany, Ireland, Switzerland, Austria, Spain, France, Italy, United Kingdom, at Brooks branded product outlets participating in the initiative and that will have displayed the advertising material inherent to this contest, while for purchases that will be made through the e-commerce website https://www.brooksrunning.com the contest will involve Austria, Belgium, Germany, Spain, France, Ireland, Italy, Luxembourg, The Netherlands, Norway, Switzerland, Sweden and the United Kingdom.


4. DURATION

Participation in the Contest is permitted from 00:01 a.m. on December 1, 2023 to 11:59 p.m. on December 22, 2023 (hereinafter, the "Participation Period") and while Ghost Max stock last in participating stores or participating brooksrunning.com locales. Awarding of prizes, possible prize draw and final draw by January 19, 2024.


5. PROMOTED PRODUCTS - OBJECTIVE OF THE CONTEST

The promoted brand is Brooks and the promoted products are Brooks Ghost Max shoes.

This contest is carried out with the intent to increase the visibility of the promoted brand.


6. DESTINATARIES

The event is open to all adults, citizens who are residents and/or domiciled in the Netherlands, Belgium, Germany, Ireland, Switzerland, Austria, Spain, France, Italy, United Kingdom, customers of the stores participating in the initiative or to all citizens of European Union countries who will purchase through the e-commerce website https://www.brooksrunning.com

The following are excluded from participation in the contest: owners, employees and collaborators and their respective spouses and cohabiting family members, of the Promoter, the Delegated Entity and the Brooks brand product outlets participating in the initiative.


7. MODALITIES OF PARTICIPATION

Recipients of the initiative, who during the period of validity of the contest, will have made a physical purchase at one of the participating outlets or a digital purchase on the portal https://www.brooksrunning.com of at least one item of the Brooks brand called Ghost Max (running shoes), of any value (single receipt), will participate in the final draw with the following two possible modes.

Physical purchase mode.

When paying for their purchase, the point-of-sale staff will show the customer a QR code. This code will have to be framed with the camera of a device enabled to read such codes (smartphone, tablet,...), alternatively the customer can connect directly to the page www.landto.me/brooksghostmax, with this procedure the participant accesses the web platform created for participation in the prize event.

The participant, once connected to the game web environment via link or QR code (see previous point), will have to register by filling out the appropriate form with the following fields: first name*, last name*, email*, municipality of residence, cell phone (*these data are required for participation in the prize contest) and sign the consent to the processing of personal data, or log in with their own credentials (last name and email) if they are already registered (any purchase after the first). The system will then ask you to enter the point of sale where you made the purchase (among those highlighted in a list), and the proof of purchase (i.e., the photo of the receipt related to the purchases made). Registration must take place within 48 hours of the issuance of the purchase receipt. The contact information provided by the participant during registration will be used as the address for communications of confirmation of winning and how to collect the prize. The Promoter assumes no responsibility for prizes that cannot be claimed due to misunderstandings caused by the participant's/winner's incorrect communication of his/her data. Each properly executed registration related to a purchase receipt made assigns the customer a title to participate in the final drawing of the sweepstakes. The data entered by the customer will be saved within a database ("database of participants") registered on Italian servers.


Digital purchase mode.

Those who make their purchases on the e-commerce portal https://brooksrunning.com during the period of the sweepstakes will participate in the final draw with a title of participation for each order placed. The master data entered when ordering online will be entered into a database of participants located on servers in Austria, Belgium, Germany, Spain, France, Ireland, Italy, Luxembourg, The Netherlands, Norway, Switzerland, Sweden and the United Kingdom.

At the end of the contest, and in any case by 19/01/2024, two different draws will be held: one relating to customers who have made physical purchases and one relating to customers who have made digital purchases.

The drawing will take place in the presence of a person responsible for the protection of the consumer and public faith indicated by the CCIAA competent for the territory.

In the case of the draw relating to customers who will have made physical purchases, one winning name will be drawn.

In the case of the draw relating to customers who have made digital purchases, three winning names will be drawn. The same customer will only be able to win one prize.

There will also be drawn, in the same way, for the draw relating to customers who have made physical purchases, no. 3 reserve winners, in case the winner cannot be found or, upon verification, does not meet the prize validation requirements; while for the draw relating to customers who have made digital purchases, no. 6 reserve winners will be drawn.

8. Prize verification and validation

The promoter reserves the right to void the win and award the prize to the first reserve drawn in the following cases:

- if the winner has not reached the age of majority and therefore is not yet 18 years old;

- if the purchaser exercises the right to cancel the physical or online order;

- in case of fraudulent participation;

- in the event that the winner becomes unavailable or fails to respond to the winning notice in the manner and within the timeframe defined therein;

- for any other reason that results in the forfeiture of the winning.


9. PRIZES

For a total prize pool of € 2,240.00 - excluding VAT for which a deposit has been provided in favor of the Ministry of Economic Development by means of an insurance guarantee.

The Barcelona Marathon prize includes:

- Overnight stay at the Hotel Arts Barcelona for the night of February 10-11, 2024 on a bed and breakfast basis;

- Roundtrip flight from the airport closest to the winner's home;

- Bib (registration) for the Barcelona Marathon.

Not included:

- Transfer from the winner's home or residence to the airport and back;

- Transfer from the airport to the hotel and vice versa;

- Meals;

- Tips;

- Anything not listed under prize includes.

The prizes up for grabs are not convertible into money, nor is it open to the winners to claim, with or without the addition of money, the possibility of receiving a prize other than the one won even if it is of lesser value. In the event that the prize up for grabs should, for reasons beyond the Promoter's control, change from what was promised, the Promoter agrees to make available to the winner a prize of no lesser value.


10. PRIZE COMMUNICATION AND ACCEPTANCE

Winners will be contacted by email in Italian and English to the contacts entered in the entry form or entered to complete the online purchase. To receive the prize, the winner will have to download, print, fill out and sign the prize acceptance forms that will be attached to the winning communication and send them within 7 days of receipt. The prize will either be picked up at the same store indicated when registering their purchases on the portal https://www.brooksrunning.com/en_gb/lets-run-bcn, or will be sent directly to the winner's home in the case of a win attributable to an online purchase at https://www.brooksrunning.com/en_gb/lets-run-bcn.

In the event of non-acceptance or unavailabilitỳ also by the Winners and Reserve Winners, always no later than 7 days from the notification of winning, the prize will be considered not awarded and the winner will be replaced by one of the reserves in chronological order of drawing.

If documentation is not received from the winner within the time specified in the winning notice, or if the documentation is not sufficient or consistent with what is required for validation, the win will be forfeited in favor of the first reserve name related to that prize, and so on. The promoter reserves the right to carry out any verifications it deems necessary in order to ensure compliance with the conditions of participation, it also reserves the right to be able to verify and compare the data of the winners, before validating the winnings, also requesting a copy of the valid identity document of the same and, if necessary, if it deems it necessary. Any entries deemed to be fraudulent and the related winnings will be verified and subjected to any checks deemed necessary; if the verifications confirm an incorrect entry, the related winnings will be cancelled. The Promoting Company, in the event of fraudulent participations, reserves the right to adopt all means to protect its interests at the appropriate venues. In case of no response even from the reserves, the related prizes will be donated to the non-profit organization.


11. DELIVERY OF PRIZES

Delivery of prizes to the eligible parties will be made by 04/02/2024.


12. COMMUNICATION

The contest will be publicized with promo-advertising material and all other means that the Promoter deems useful to spread awareness of the contest to the recipients of the contest; advertising messages will be consistent with these regulations.

13. MISCELLANEOUS

In the event that the winners refuse the prizes in writing, they will revert to the Promoter Company's availability. The Promoter declares to renounce to exercise on the winners of the prizes the IRPEF withholding tax recourse provided for by art. 30 of Presidential Decree No. 600 of 29/09/1973. In the event that the prizes are not usable by the winners, there will be no right to the payment of any sum of money, due to the prohibition expressed in Article 51 of Royal Decree Law No. 1933 of October 1938.


14. PROCESSING OF PERSONAL DATA AND INFORMATION PURSUANT TO ARTICLE 13 OF THE DATA PROTECTION REGULATION (EU) 2016/679

The Policy applies to information we collect when you use our website or mobile applications, store at our stores, attend one of our events, or interact with us as described below (referred to as the "Services"). We may make changes to this Privacy Policy from time to time. If we make any changes, we will notify you by correcting the date of the "Last Updated" above and, in the event of any material changes, we will provide you with additional notifications (such as adding a notice on our website or sending you an email notification). We encourage you to review this Privacy Policy whenever you interact with us so that you remain informed about our information practices, how we process your personal information, and the choices available to you.


Information we collect

We collect information that you provide to us directly. For example, we collect information when you: access or use the Services; purchase our products; review a product; participate in a survey, contest, promotion, activity, or event; subscribe to our marketing newsletter; communicate with us through third-party social media sites; request customer support; or otherwise communicate with us. The types of information we collect directly from you may include personal information such as your name, username, email address, mailing address, phone number, date of birth, payment method information, photographs, videos, social media profiles, and any other information you choose to make available to us. To suggest to the customer which product to choose and better understand running habits, we may ask for gender, foot width, weight, type of physical activity performed, pronation, demographic and biographical information, injuries, and running assessment data.

This information may be provided when using our online Run Signature tool or in our stores. In the future, and with your consent, we may collect scans of your feet to provide shoe suggestions and make customized shoes. You may also choose to provide us with information and numerical measurement data related to Your running sessions, including mileage, duration, heart rate, foot-ground reaction force, speed, etc. ("Running Data"). We may collect such information when You participate in a research study with us or in the event that You choose to share with us the Running Related Data from Your fitness tracking device.
